By accessing and using RefGen AI (the "Service"), you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service. The Service is operated by RefGen AI Team ("we", "us", or "our") and is accessible via Telegram messenger.

2. Service Description

RefGen AI is an AI-powered image generation service that transforms text prompts and basic sketches into professional-quality images. The Service utilizes advanced AI models including Google Cloud Models and Neural Upscale technologies. We provide various generation modes including Smart Optimization, God Mode, and Pro Upscaling.

3. User Accounts and Access

To use the Service, you must have a valid Telegram account. By using the Service, you represent that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will provide accurate information when required
  • You will not share your account access with others

4. Acceptable Use Policy

You agree not to use the Service to:

  • Generate illegal, harmful, or offensive content
  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of others
  • Generate images of real individuals without consent
  • Create misleading or deceptive content (deepfakes)
  • Harass, abuse, or harm others
  • Attempt to bypass usage limits or restrictions
  • Reverse engineer or copy the Service

Content Responsibility: Users are responsible for ensuring they have the rights to any materials they upload. We may remove or restrict content that infringes copyright.

We reserve the right to suspend or terminate access for violations of this policy.

5. Intellectual Property

Your Content: You retain ownership of prompts and inputs you provide. By using the Service, you grant us a license to process your inputs for the purpose of generating images.

Generated Images: Subject to these Terms and your compliance with them, you own the images generated through the Service. However, similar images may be generated for other users with similar prompts.

Service IP: All rights, title, and interest in the Service, including our AI models, algorithms, and software, remain our exclusive property.

6. Service Purpose and Limitations

The Service is provided for creative and informational purposes only and is not intended for professional, medical, legal, or financial advice. Any use of generated content for critical decision-making should be independently verified.

7. Third-Party Services

The Service may use third-party APIs and infrastructure, including Google Cloud. RefGen AI is an independent product and is not affiliated with Google LLC. Your use of the Service is also subject to Telegram's Terms of Service and Privacy Policy.

8. Subscription and Payment

We offer both free and paid subscription tiers. Free tier users receive limited monthly generations. Paid subscriptions provide additional features and increased generation limits.

  • Subscriptions automatically renew unless cancelled
  • You may cancel your subscription at any time
  • Refunds are provided according to our refund policy
  • Prices may change with 30 days notice to existing subscribers
  • Unused generations do not roll over between billing periods

9. Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Indemnification

You agree to indemnify and hold harmless RefGen AI and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via the Service or Telegram. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable international laws and regulations. Any disputes shall be resolved through binding arbitration in accordance with international arbitration rules.
